Terms of Service for Wisper AI on Mac. Last updated .

In short
  • Wisper turns your voice into text using AI. AI can make mistakes — check the text before you send or rely on it.
  • Your recordings and text belong to you. We use them only to provide Wisper to you, never to train AI models.
  • The free plan has daily limits. Pro is a subscription through the Mac App Store that renews automatically until you cancel it in your Apple Account settings.
  • Billing and refunds are handled by Apple.
  • Don’t record people without the consent the law requires, and don’t use Wisper for anything illegal or abusive.
  • Polish law applies, and you keep every protection that the consumer law of your country gives you.

This summary is for convenience. The full text below is what applies.

1. The agreement

These Terms of Service (“Terms”) are an agreement between you and Candy Studio Apps, Filtrowa 65/38, 02-055 Warszawa, Poland (“we”, “us”), for your use of Wisper AI for Mac, including the menu-bar app, the Wisper bar and widgets (“Wisper” or the “App”) and the services we provide through it.

By downloading, installing or using Wisper you accept these Terms. If you don’t agree, don’t use the App. Our Privacy Policy explains how we handle your data and forms part of these Terms. These Terms are the end-user license agreement for the App and apply instead of Apple’s Standard End User License Agreement. The language of these Terms is English.

2. The service

Wisper is a voice dictation app. It records your voice when you ask it to, turns your speech into text with AI, cleans the text up (removing filler words, adding punctuation, applying your style, dictionary and snippets), and inserts it where you are typing. It also lets you keep notes, and create summaries, key points, flashcards, rewrites and translations, and chat about a note.

  • On Mac you dictate with a keyboard shortcut into any app, or in the app. Pasting into other apps needs the macOS Accessibility permission.
  • Most features need an internet connection and use our servers and third-party AI providers, described in the Privacy Policy.
  • Wisper requires a Mac with macOS 14 or later. Some features depend on your device, operating system and region.

3. Eligibility

You must be at least 16 years old, or the age of digital consent in your country if lower (and never under 13), to use Wisper. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these Terms for you. If you use Wisper for an organization, you confirm you are allowed to accept these Terms for it.

4. Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing where it is enabled for a purchase), for your own personal or internal business use, in line with these Terms.

You may not: copy, modify or create derivative works of the App; reverse-engineer, decompile or disassemble it, except where the law allows this despite this restriction; rent, lease, sell, sublicense or redistribute it; remove proprietary notices; access our servers or AI features other than through the App (for example with scripts, bots or automated requests); or circumvent usage limits, payment or security measures.

5. Free plan and fair use

  • Free plan. You can use Wisper for free within limits, such as a number of dictations per day, a maximum recording length and limited AI features. The current limits are shown in the App and may change.
  • Pro. A Pro subscription removes the daily dictation limit and unlocks longer recordings and Pro features, as described in the App when you subscribe.
  • Fair use. Pro is meant for one person’s normal use. To keep Wisper fast and affordable for everyone, we apply technical limits on recording length and on the amount of audio processed per day and per month, which ordinary use does not reach. If usage is unusually high or automated, we may slow down or pause processing and will contact you where we can.
  • Changes to features. We continually improve Wisper and may add, change or remove features. If we remove a feature that is a core part of a paid subscription you have already bought, you can cancel and, where the law requires, receive a proportional refund.

6. Subscriptions and billing

Pro is sold as an auto-renewable subscription through the Mac App Store (for example weekly, monthly or yearly, as shown at purchase). Prices are shown in the App in your local currency before you buy, including any taxes the store charges.

  • Payment is charged to your Apple Account when you confirm the purchase.
  • Your subscription renews automatically for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
  • Free trials. If a plan includes a free trial, it converts into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial ends when you buy a subscription. Trials are available once per person and plan.
  • Manage or cancel in the App Store → your account → Subscriptions on your Mac, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current period and you keep Pro until then. Deleting the App does not cancel your subscription.
  • Price changes are handled by Apple, which notifies you in advance and asks for your consent where required.
  • Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
  • A subscription bought on one Apple device may also unlock Wisper on your other supported Apple devices that use the same Apple Account and iCloud.

Right of withdrawal (EU and UK consumers). When you start a subscription or a trial, you ask for the service to start immediately. Your statutory right to withdraw from a contract for digital services within 14 days applies as provided by your country’s law and the store’s procedures; once the service has been fully provided, or where the law allows it to be excluded with your consent, it may no longer apply. Withdrawal and refund requests for store purchases are processed by Apple.

7. Your content

  • You own it. Your recordings, transcripts, notes and the text Wisper produces for you (“Your Content”) belong to you, to the extent the law gives anyone rights in them. We claim no ownership.
  • Permission to process. You give us a limited, worldwide, royalty-free permission to process Your Content only to provide Wisper to you — for example to transcribe, clean up, translate and summarize it — including through our service providers. This permission ends when the processing is done, as described in the Privacy Policy.
  • No training. We don’t use Your Content to train AI models.
  • Your responsibility. You are responsible for Your Content and for having the right to record and process it. Many countries require the consent of everyone you record, for example in a meeting or a call. Get that consent before recording other people, and respect confidentiality obligations you have.

8. AI output

Wisper uses speech recognition and language models. You understand that:

  • output can be inaccurate, incomplete or unexpected — names, numbers and technical terms can be misheard, and a style or translation can change the meaning;
  • you should review the text before you send, publish or act on it, especially when inserting it automatically into other apps;
  • output is not professional advice and must not be relied on without human review for medical, legal, financial, safety-critical or emergency matters;
  • output may reflect limitations or biases of the underlying models, and similar requests can give different results.

9. Acceptable use

You agree not to use Wisper to:

  • break any law, or record or transcribe people without the consent or notice the law requires;
  • create or transmit content that is illegal, harmful, harassing, defamatory, or infringes others’ rights;
  • interfere with or overload our servers, probe them for vulnerabilities, or access data that isn’t yours;
  • use Accessibility, the dictation key or other permissions for anything other than Wisper’s intended dictation features, or to get around the security of other apps;
  • resell, share or provide Wisper as a service to others, or use its output to develop competing AI models;
  • break the terms of the apps and platforms you dictate into.

We may suspend or end access for serious or repeated breaches, as described in section 16.

10. Permissions

Wisper uses the macOS Accessibility permission to detect your dictation shortcut, paste text into other apps and, if you use Edit with voice, read the text you selected. The Privacy Policy explains exactly what it accesses. You can turn it off at any time in System Settings → Privacy & Security → Accessibility; Wisper then copies your text to the clipboard for you to paste.

11. Third-party services

Wisper relies on third-party services, including speech-to-text and language-model providers, Apple for distribution and payments, RevenueCat for subscription management, and analytics and infrastructure providers, listed in the Privacy Policy. Their availability can affect Wisper. You must also comply with any third-party terms that apply to your use, such as your Apple Media Services terms and your mobile data plan. We aren’t responsible for third-party websites or services that Wisper links to.

12. Our intellectual property

The App, its software, design, text, graphics and the Wisper name and logo are owned by us or our licensors and protected by intellectual-property laws. These Terms don’t give you any rights in them except the license in section 4. Other names and trademarks mentioned in the App belong to their owners.

If you send us feedback or ideas, we may use them freely without obligation to you.

13. Changes and availability

We work to keep Wisper available and working well, but it may sometimes be unavailable — for example during maintenance, updates, outages of our providers, or events outside our control. We may update the App; some updates may be required to keep using it. If we decide to discontinue Wisper, we will give reasonable notice where possible.

14. Disclaimers

We provide Wisper with reasonable care and skill. Apart from that, and to the extent the law allows, Wisper is provided “as is” and “as available”, and we don’t promise that it will be uninterrupted or error-free, that AI output will be accurate, or that it will meet every need. If you are a consumer, you keep all statutory rights, including the legal guarantee that digital content and services conform to the contract, and nothing in these Terms limits them.

15. Limitation of liability

  • Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for damage caused intentionally or through gross negligence, or any other liability that cannot be limited or excluded by law, including under mandatory consumer-protection law.
  • Subject to that, we are not liable for indirect or consequential losses, lost profits or business, or losses caused by AI output you didn’t review, by content you inserted into other apps, or by your breach of these Terms.
  • Subject to that, our total liability arising from or relating to Wisper is limited to the amount you paid for Wisper in the 12 months before the claim arose, or EUR 50 if that is higher.
  • Keep your own copies of important notes. Notes are stored on your device, and we can’t restore them if your device is lost or the App is deleted.

16. Termination

You can stop using Wisper at any time by deleting the App and cancelling your subscription in the Mac App Store. We may suspend or end your access if you seriously or repeatedly breach these Terms, if the law requires it, or to protect Wisper or other users — with notice and a chance to respond where reasonable. If we end your access without your fault, you will receive a proportional refund of any prepaid subscription where the law requires. Sections that by their nature should survive (such as 7, 8, 12, 14, 15 and 17) survive termination.

17. Governing law and disputes

  • These Terms are governed by the laws of Poland. If you are a consumer living in another country, you also keep the protection of the mandatory laws of your country of residence.
  • Disputes will be decided by the common courts in Warsaw, Poland. If you are a consumer, you may also bring proceedings in the courts of your country of residence, and we may only sue you there.
  • Complaints. Send any complaint to support@wisperai.app describing the problem. We will reply within 14 days. If we can’t resolve it, consumers may use out-of-court dispute resolution, such as a local consumer ombudsman or, in Poland, the consumer bodies listed by the Office of Competition and Consumer Protection (UOKiK).

18. Apple terms

You acknowledge that:

  1. These Terms are between you and Candy Studio Apps only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
  2. Your license to use the App is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  3. We, not Apple, are solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support for it. Contact us at support@wisperai.app.
  4. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our responsibility.
  5. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
  6. If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  7. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with applicable EU sanctions.
  8. Questions, complaints or claims about the App go to: Candy Studio Apps, Filtrowa 65/38, 02-055 Warszawa, Poland, support@wisperai.app.
  9. You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement.
  10. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

19. Changes to these terms

We may change these Terms to reflect changes to Wisper, the law, or our business. The date at the top shows the latest version. If a change is significant, we will tell you in the App before it takes effect, at least 14 days in advance where reasonably possible. If you don’t agree to a change, you can stop using Wisper and cancel your subscription before it takes effect; continuing to use Wisper afterwards means you accept the updated Terms.

20. General

If any part of these Terms is found invalid or unenforceable, the rest stays in effect. If we don’t enforce a right, we haven’t waived it. You may not transfer your rights under these Terms without our consent; we may transfer ours to a company that takes over Wisper, as long as your rights as a consumer are not reduced. These Terms, together with the Privacy Policy, are the entire agreement between you and us about Wisper.
